This website, schoolponytails.com.au (the Website), is operated by School Ribbons Pty Ltd trading as School Ponytails (School Ponytails, we, us or our). We use Shopify to provide the online store platform. When you use the Website or place an order, these Terms of Service (Terms) apply, together with the policies linked below. Please read them before ordering.
Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including rights under the Australian Consumer Law (ACL).
1. Using the Website
You must use the Website lawfully and must not interfere with its operation or security, transmit malicious code, misuse another person's information, or use our content for commercial purposes without permission. A parent or guardian is responsible for orders placed by a child with their permission. We may restrict access where reasonably necessary to protect the Website, other users or our business, or to comply with law.
We aim to keep information on the Website accurate and current, but occasional errors may occur. Product information and images should be read together with the description and options shown on the relevant product page. Screen settings and lighting may affect how colours appear. If an exact colour match is important, contact us before ordering.
2. Products, prices and orders
Product availability, descriptions, prices and promotions may change for future orders. The price and any applicable delivery charge will be displayed before you submit an order. Prices are in Australian dollars unless the Website clearly states otherwise. Any applicable GST is included in displayed consumer prices.
When you submit an order, you offer to purchase the selected products. We will send an order acknowledgement to the email address you provide. If we cannot fulfil an order because an item is unavailable, there is an obvious pricing or listing error, or we reasonably suspect an unauthorised or fraudulent transaction, we will contact you as soon as practicable. We may offer a correction or alternative; you may decline it and receive a refund of any amount paid for the affected item. We will not charge a higher price for an order without your agreement. Your statutory rights remain unaffected.
You must provide accurate contact, delivery and payment information and promptly let us know if it changes. Payment is processed through the payment methods displayed at checkout and their applicable terms. Do not send payment card details by email.
3. Custom and made-to-order products
Please check your chosen colours, product type, quantity, personalisation and any other custom instructions before placing an order. We may contact you if instructions are unclear. Production and dispatch estimates for custom or made-to-order items are estimates unless we expressly agree to a particular date. If we expect a material delay, we will contact you with available options.
The change-of-mind rules for custom products, if any, are set out in our [Returns and Refunds Policy](/policies/refund-policy). Customisation does not remove your ACL rights if an item is faulty, unsafe, materially different from its description, or otherwise fails a consumer guarantee.
4. Delivery and local pickup
Available shipping methods, charges and delivery estimates appear at checkout or in our Shipping Policy. Delivery estimates can be affected by production time, carriers and events outside our reasonable control. We will take reasonable steps to keep you informed about significant delays and address orders that do not arrive in accordance with applicable law.
Where local pickup is offered, the pickup arrangements and instructions provided at checkout or in your pickup notification apply. Please collect only after you receive confirmation that your order is ready.
5. Returns, refunds and consumer guarantees
Our Returns and Refunds Policy explains our voluntary change-of-mind arrangements and how to contact us about a problem. It operates in addition to your legal rights.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Please contact us at Hello@SchoolPonytails.com.au if you believe a product has a problem. We will assess the issue and provide the remedy required by law. We will not require you to deal with a manufacturer instead of us to exercise your rights against us.
6. Wholesale, fundraising and school programs
If you purchase through a wholesale account, school order form, fundraiser, or other special program, any clearly disclosed program terms and agreed prices also apply. If there is an inconsistency about a program-specific commercial arrangement, its specific terms take precedence to the extent permitted by law. Nothing in those arrangements limits any right that cannot lawfully be excluded. Contact us before ordering if you need clarification about an offer, commission, consolidated delivery or production timeframe.
7. Accounts and customer communications
You are responsible for keeping your account login secure and for activity authorised through your account. Tell us promptly if you believe your account has been used without permission. We may suspend an account where reasonably necessary to investigate misuse or protect customers, and will act reasonably in doing so.
We use the contact details you provide to communicate about your order, account and customer service. Marketing communications are handled in accordance with your choices, our Privacy Policy and applicable law.
8. Intellectual property and customer submissions
The Website's text, photographs, graphics, branding and other content belong to us or our licensors unless indicated otherwise. You may use the Website for personal shopping and ordinary business purchasing, but may not reproduce or commercially exploit its content without permission.
If you submit a review, photograph or other material for publication, you confirm that you have the right to provide it and that it does not infringe another person's rights. You grant us a non-exclusive licence to display and use that material for the purpose for which you submitted it. We may moderate or remove submissions that are unlawful, misleading, infringing or inappropriate. We will seek separate permission before using an identifiable customer photograph in unrelated advertising unless you have expressly agreed to that use.
9. Third-party services and links
Shopify, payment providers, carriers and other third parties may help us operate the store. Their own terms may apply when you use their services. Links to other websites are provided for convenience; we do not control those websites. This section does not reduce our responsibilities as the seller of products you buy from us or any responsibility we have under applicable law.
10. Privacy
Our Privacy Policy explains how personal information is collected, used, disclosed and stored. Please read it alongside these Terms.
11. Website availability and liability
We take reasonable care in operating the Website, but cannot promise uninterrupted access or that it will always be free of technical errors. We may temporarily suspend access for maintenance, security or other reasonable operational reasons.
To the extent permitted by law, we are not responsible for loss arising solely from a customer's unlawful use of the Website or from circumstances beyond our reasonable control. This does not exclude our liability for our own conduct where liability cannot lawfully be excluded. Nothing in these Terms limits your ACL remedies, including any entitlement to compensation for reasonably foreseeable loss or damage.
12. Changes to these Terms
We may update these Terms by posting a new version on the Website with an updated date. Changes apply to use of the Website and orders placed after the new version takes effect. The terms applicable when you placed an order will continue to govern that order unless we and you agree otherwise or the law requires a different outcome.
13. General
If a provision of these Terms is unenforceable, the remaining provisions continue to apply to the extent they can operate independently. A delay in enforcing a right does not waive that right. These Terms and the policies and program terms expressly referred to in them describe the arrangements for using the Website and ordering from us, subject to rights that cannot lawfully be excluded.
These Terms are governed by the laws of Western Australia and applicable Commonwealth laws. Nothing in this clause prevents a customer from exercising rights available under applicable consumer law.
